Guidance on Workplace Temperature and Protective Clothing

Workers of England Members often raise concerns about cold offices and the safety of working outside in low temperatures and darkness. Although the UK does not set a strict legal minimum or maximum workplace temperature, several laws place clear duties on employers to protect staff.


The Workplace (Health, Safety and Welfare) Regulations 1992 require employers to maintain a “reasonable” indoor temperature. While not legally binding, the accompanying Approved Code of Practice advises that 16°C is generally acceptable for someone that tends to spend work seated, and 13°C for more physically demanding tasks.

Employers must monitor conditions and take action when temperatures fall below a reasonable level, including providing heating or adjusting work practices.

The Management of Health and Safety at Work Regulations 1999 require employers to carry out risk assessments that specifically consider exposure to cold, darkness, and related hazards.

This includes evaluating the risk of cold stress, reduced visibility, and slips or falls. Employers must then implement control measures such as warm-up breaks, access to hot drinks, additional lighting, and safe planning of outdoor tasks during adverse conditions.

Where protective clothing is needed, the Personal Protective Equipment at Work Regulations 2022 apply. If a risk assessment identifies cold-weather clothing or high-visibility garments as necessary for safety, employers must provide them free of charge.

This may include thermal layers, waterproof outerwear, gloves, hats, or visibility-enhancing clothing for dark environments.

The Health and Safety at Work etc. Act 1974 places an overarching duty on employers to ensure the health, safety, and welfare of employees. This includes consulting staff on temperature issues and responding promptly to concerns.
