
When Another Union Takes Strike Action
Are you concerned about your rights and responsibilities when a different union initiates strike action at your workplace? The Workers of England Trade Union has compiled this guide to clarify where you stand and how best to protect your interests.
What Action Might Your Employer Take?
While it’s unlawful for an employer to dismiss you unfairly, some managers still attempt it. More commonly, your employer may deduct money from your wages if you fail to attend work during another union’s strike. This is considered a breach of contract since you’re not fulfilling your contractual duties. Deductions will apply to any employee who participates in the strike.
In addition, there may be potential for disciplinary measures, ranging from warnings to more severe penalties. However, you have the right not to be dismissed purely for taking part in industrial action. Should your employer begin disciplinary proceedings, the Workers of England will be ready to represent you and help you state your case.
Industrial Action by Non-Union Members
Non-union members who join in legal, official industrial action enjoy the same protection against dismissal as union members. Your decision to take part—whether you’re in a union or not—cannot be the sole reason for your dismissal.
Crossing a Picket Line
You have the right to cross a picket line if you do not support the industrial action. If colleagues threaten or intimidate you for doing so, report their behavior to the police.
If you’re unable to cross the picket line, you must demonstrate to your employer that you made every reasonable effort. Without proof of that effort, they may treat you as if you joined the strike and withhold pay.
